REFUND AND RETURN POLICY

1. Introduction and Scope

-------------------------

This Refund and Return Policy ("Policy") applies to all purchases of photomicrographic fine art

prints, framed artwork, and related merchandise (collectively, "Products") sold by bmoremicro, a

general partnership organized under the laws of the State of Maryland (the "Partnership," "we,"

"us," or "our"), whether the purchase is made through our website, at art fairs or galleries, by

direct communication, or by local pickup within Baltimore City, Maryland. By placing an order,

the purchaser ("Buyer," "Customer," or "you") agrees to the terms of this Policy, which is

incorporated by reference into our Terms and Conditions.

2. General Policy — Sales Are Final Absent a Qualifying Claim

Each Product is a limited-run or made-to-order fine art reproduction, individually cut, mounted,

matted, and/or framed upon order. Because of the bespoke nature of production, all sales are

final except as expressly set forth in Section 3 of this Policy. We do not offer refunds,

replacements, or store credit for buyer's remorse, a change of preference, subjective

dissatisfaction with color rendering on a personal display device, or the ordinary variation

inherent in fine-art photographic printing.

3. Qualifying Claims — Damaged, Defective, or Materially Misdescribed Products

You may be eligible for one of the discretionary remedies described in Section 4 if a Product:

(a) arrives physically damaged in transit; (b) is defective as a result of a printing, mounting,

or framing error attributable to us; or (c) materially and substantively differs from the

description published at the time of sale. Eligibility for any remedy is subject to each of the

following conditions:

* Notice to [email protected] within seven (7) calendar days of the delivery date

reflected on the carrier's tracking record, or within seven (7) calendar days of local pickup;

* Your order number, a written description of the claimed defect or damage, and clear, unedited

photographs of the Product, its packaging, and any shipping label showing visible damage;

* The Product must remain in the condition delivered — unaltered, unreframed, and not further

damaged by any act or omission of the Buyer after receipt; and

* You must make the Product reasonably available for our inspection, and, if we so request, return

it to us at a location and by a shipping method we designate, before any remedy is issued.

Claims submitted outside this seven (7) day window, or lacking the supporting information above,

will not be considered.

4. Available Remedies — No Guaranteed Free Replacements or Full Refunds

Upon our review and verification of a qualifying claim under Section 3, we may, in our sole and

reasonable discretion, offer one or more of the following remedies:

* a partial refund reflecting the diminished value of the affected Product, taking into account

the nature and extent of the defect or damage;

* a replacement of the affected Product, subject to the availability of matching print stock,

matting, and framing materials, and subject to a reasonable additional production and shipping

period; or

* store credit toward a future purchase of equal or lesser value.

We do not represent or warrant that any remedy — including a free replacement or a full refund —

will be available in any given case. Any remedy extended under this Policy is offered as a

courtesy based on the specific facts presented and remains subject to our sole discretion.

Nothing in this Policy shall be construed as creating an entitlement to a full refund, a free

replacement, or expedited reshipment.

5. Non-Qualifying Requests

--------------------------

We will not issue a refund, replacement, or credit for, among other things:

* claims first reported after the seven (7) day window described in Section 3;

* damage or deterioration occurring after delivery or pickup, including damage caused by improper

hanging, mounting, cleaning, humidity exposure, or handling by the Buyer or a third party;

* normal and expected variation in tone, grain, contrast, or texture inherent to photomicrographic

reproduction, or the natural variation between wood, metal, or composite framing materials;

* perceived color differences attributable to the calibration of the Buyer's monitor, phone, or

other display device;

* custom, special-order, or commissioned pieces once production materials have been cut or

printing has commenced; and

* Products transferred by local pickup, once the Buyer has taken possession following the

inspection opportunity described in Section 7.

6. Authorized Returns, Return Shipping, and Restocking

If we authorize a return, the Product must be returned in its original or equivalent protective

packaging wherever reasonably possible. Unless the return results from our error, the Buyer is

responsible for return shipping costs, and we may deduct a restocking fee of up to twenty

percent (20%) of the purchase price from any partial refund to account for materials, custom

framing, and labor already expended in fulfilling the order.

7. Local Pickup Orders (Baltimore City)

---------------------------------------

For orders fulfilled by local pickup within Baltimore City, Maryland, the Buyer is required to

inspect the Product at the time and place of pickup, before taking possession. A claim of damage

or defect first raised after the Product has left our possession at pickup is presumed, absent

clear evidence to the contrary, to have arisen after transfer of custody, and will not qualify

for a remedy under this Policy, except where a latent manufacturing defect could not reasonably

have been discovered upon a visual inspection at pickup — in which case the seven (7) day notice

window described in Section 3 continues to apply, measured from the pickup date.

8. How to Submit a Claim

------------------------

Send an email to [email protected] including your order number, the date of delivery or

pickup, a description of the issue, and the photographs described in Section 3. We aim to

acknowledge all claims within five (5) business days of receipt. We are unable to evaluate or

process any claim submitted without this information.

9. Sales Tax on Refunds

-----------------------

Where a partial refund is issued, we will include a proportional refund of any Maryland sales

and use tax collected on the affected portion of the order, consistent with regulations

administered by the Comptroller of Maryland.

10. Refund Processing and Payment Timing

----------------------------------------

Any approved refund or partial refund will be issued to the Buyer's original method of payment.

Processing times for the funds to post are controlled by the Buyer's card issuer or financial

institution and are typically five (5) to ten (10) business days from the date we submit the

refund instruction; we are not responsible for delays attributable to third-party financial

institutions or payment processors.

11. Modification of This Policy

-------------------------------

We reserve the right to amend this Policy at any time. The version of this Policy in effect at

the time an order is placed governs that transaction, unless a subsequently effective version is

required to apply by operation of law.

12. Governing Law and Statutory Consumer Protections

----------------------------------------------------

This Policy is governed by the laws of the State of Maryland, without regard to its

conflict-of-laws principles, and is intended to operate in a manner consistent with the Maryland

Consumer Protection Act, Md. Code Ann., Com. Law §§ 13-101 et seq., and applicable Maryland

statutory and regulatory requirements concerning the disclosure of merchant return and refund

policies. Nothing in this Policy is intended to, or shall be construed to, limit or waive any

non-waivable right or remedy available to a consumer under Maryland or federal law.
